PACKAGE TOUR SERVICE AND SALES AGREEMENT

ARTICLE 1: PARTIES

This agreement is located at Güzeloba, Rauf Denktaş Cd No:17 D:1, 07230 Muratpaşa/Antalya Turkey.
TTtouristic SEYAHAT Teknoloji Acenteliği VE TURİZM AŞ (referred to as TT Touristic in the Agreement) with the contact number 902426061630 and …………, which resides at the address xxxxxxxxx and whose contact information is xxxxxxxx@xxxx.com, 05xx xxx xx xx. . ………. , Turkish ID Number ……………., (referred to as CONSUMER in the Agreement).

(The consumer who purchases or undertakes to purchase any package tour service, on whose behalf or in whose favor a package tour service is purchased or is undertaken to be purchased, or to whom a package tour service and sales contract is transferred, will be referred to as the Participant.)

ARTICLE 2: SUBJECT

This agreement includes the regulation of the service, payment terms and rights and obligations of the parties regarding the service and package tour received by the Consumer from TT Touristic on behalf of himself and the participant, within the framework of the conditions explained below.

The Consumer agrees that, upon the request of the Hotel, he/she will pay the “Accommodation Tax” to the Hotel in which he/she will stay, that the “Accommodation Tax” is not included in the price he/she will pay to TT Touristic in accordance with this agreement, and that the Agency/TT Touristic is not responsible for the taxes to be paid to the Hotel in which he/she will stay, in accordance with the legal regulation. He declares, accepts and undertakes that he is aware of the issue and that he has been enlightened/informed about the issue by the Agency/TT Touristic. This contract covers the services specified in the Preliminary Information Brochure, Voucher, Tour Program and Collection Receipt, which are an annex and integral part of the contract.

ARTICLE 5: RIGHTS AND OBLIGATIONS OF THE PARTIES

5.1- If the tour/service purchased by the Consumer is sold in installments, the Consumer must within 7 days from the date the installment sales contract is made/created, and if there is no 7-day period between the reservation date and the start date of the tour, 3 days before the tour start date at the latest, may withdraw from the contract in writing without giving any reason and without paying any penalty. However, the notification regarding the exercise of the right of withdrawal must be directed to and delivered to TT Touristic within these periods. The consumer cannot exercise his right of withdrawal in service contracts where the performance of the service begins with the approval of the consumer before the right of withdrawal expires. In case the consumer defaults in paying the installments in the installment sales contract, TT Touristic has fulfilled all its obligations in accordance with the contract, the remaining debt of the consumer will be paid at least 2 consecutive installments constituting at least 1/10 of the total debt or at least 1/4 of the remaining debt. In case of default in paying an installment, first of all, the consumer is given a warning of at least 30 days of maturity. However, if the debt is not paid, TT Touristic has the right to request the full performance of the remaining debt. This provision of the contract is based on Article 2/4 of the Regulation on Installment Sales Contracts. In accordance with the article, it does not apply to sales made by credit card.

5.2-The consumer acknowledges that he/she has reviewed the tour promotion brochure sent to him/her by TT Touristic for preliminary information purposes before the establishment of this contract, the tour, the accommodation facility, the total tour price including taxes, the prepayment amount and the date on which the remaining amount will be paid, within the scope of the services that constitute the package tour; the start/end date and place of the tour/journey, the type of transportation vehicles used/to be used and the class of the journey, departure and return dates, times and places, accommodation dates and type, location, qualifications, class and if this classification is different from the one applied in Turkey, warnings regarding this difference, the meal plan, the route to be followed during the journey, information regarding passport, visa, age and health conditions in accordance with the characteristics of the package tour, the deadline to notify the Consumer of the cancellation of the package tour depending on the accrual of the conditions, information regarding tourist guidance, 14/9/1972 The information regarding the compulsory insurance and other insurances, if any, in accordance with the Law on Travel Agencies and Association of Travel Agents No. 1618 dated 1618, and the information/necessary information regarding other details in the brochure are understandable, and a copy of the preliminary information brochure and travel program given to him/her by TT Touristic before the contract is established. that it is also included in the annex of this contract, that the Permanent Data Storage and the provisions of this contract have been explained/notified to him separately, that he has signed this contract on behalf of the Participant/s who will participate in the tour/use the service in accordance with the contract, all the information given to him, the tour brochure and the contract. He/she declares and accepts that he/she has/will inform the Participant(s) about the details, that this obligation belongs to him/her, that the information provided to him/her will be deemed to have been provided to the other participant/s, and that the contract has been drawn up and signed/approved in line with his expressed will to accept the contract.

5.3-As a rule, the consumer is obliged to pay the full package tour/service fee at the time of reservation. However, if the Consumer cannot pay the full package tour/service fee at the time of reservation due to reasons arising from the Consumer, he/she must pay at least 35% of the package tour/service (reservation) fee at the time of reservation and the remaining balance (65%) within 15 days from the date of reservation. is obliged to pay. The consumer declares, accepts and undertakes that he/she is aware that the reservation will not be finalized and visa procedures cannot be started for international tours without making the full payment, and that TT Touristic has been informed about this. If there is less than 15 days between the reservation date and the package tour (service start date), the Consumer is obliged to pay the full package tour/service (reservation) fee at the time of reservation, otherwise the reservation will not be finalized and visa procedures cannot be started for overseas tours, hence TT Touristic declares, accepts and undertakes that it will not be responsible. If payment(s) are not made within the period(s) specified above, the contract is deemed to be terminated unilaterally by the Consumer without justifiable reason. The contract is terminated unilaterally by the Consumer without making payment(s), and if there is less than 30 days until the start date of the package tour as of the date of termination of the contract, the payment made by the Consumer will be recorded as “compensation for withdrawal from the contract” by TT Touristic and no refund will be made to the Consumer. .

5.4- In case of a price increase in the price of the product/service subject to the contract after the contract is signed/made, but before the service is used, the Consumer will not be charged a difference fee due to the price increase, and the price/price of the product/service will decrease (for example, the price will be reduced by taking action by the Hotel to which the reservation has been made). In case it is reduced, no refund will be made to the Consumer. However, in case of package tours abroad where the contract price is determined in foreign currency, there is an extraordinary increase in the exchange rate, changes in taxes, duties, fees and similar legal obligations collected in places such as ports and airports, and an extraordinary increase in transportation costs, including fuel expenses. (A price increase of more than 2% will be considered an unusual increase) The consumer accepts that TT Touristic has the right to make changes in prices and conditions not to exceed 5% of the contract price.

5.5-If it is not possible for the consumer to continue the purchased tour/service, the consumer may transfer his/her reservation to a third party who will fulfill all conditions valid for the contract by notifying TT Touristic at least 7 days before the departure date. In this case, the Consumer(s) who transfer and take over the contract are jointly and severally responsible for the balance amount against TT Touristic and the payment of all additional costs arising from such transfer. For tours with airplane transportation, this situation is evaluated in accordance with the cancellation and change conditions of the carrier airline company. Visa fees/fees paid for obtaining a visa for Consumers/Participants whose visa process has been completed regarding the reservation transferred for overseas tours will not be refunded. Visa responsibilities of the Consumer(s) who take over the package tour/reservation will be their own. In case the consumer(s) do not have a visa or cannot obtain a visa from the relevant institution or authority until the tour start date despite having applied, TT Touristic cannot be held responsible and the transferor and transferee are obliged to pay the entire tour fee jointly and severally to TT Touristic. If the person transferring the service/tour does not have the same status as the transferor, the transfer will not take place or the transfer process will be completed by removing the special discounts.

5.6-Significant changes made to the content of the contract before the start of the package tour/service for reasons not caused by the Consumer, and other changes in prices, etc. other than the prices and changes made for the reasons specified in Article 5.4, are considered as fundamental contract changes. Fundamental contract changes and the impact of these fundamental contract changes on the price are immediately notified to the Consumer by TT Touristic in writing and/or via a permanent data recorder. Following the notification, the consumer may immediately accept the change notified in writing or via a permanent data storage device, provided that he/she notifies TT Touristic in writing or via a permanent data storage device that he/she does not accept the change;

a) Participating in another package tour of equal or higher value offered by TT Touristic without paying an additional fee,

b) Participating in a package tour of lower value, provided that the price difference is refunded to him/her,

c) It may exercise one of its rights to withdraw from the contract without paying any compensation.

In case of withdrawal from the contract by the Consumer, the price paid by the Consumer will be refunded to the Consumer without any deduction, within 14 days at the latest from the date on which the notification of withdrawal from the contract reaches TT Touristic. Although TT Touristic has notified him/her of the fundamental contract changes and the impact of these fundamental contract changes on the price in the above procedures, if the Consumer does not respond to the notification and/or does not inform TT Touristic which of the above-mentioned rights he/she has exercised through the above-mentioned procedures, including the price increases notified to him/her. It will be deemed to have accepted the new conditions in the nature of this additional contract, which includes fundamental changes in the package tour service and sales contract and changes the essential elements of the package tour service and sales contract, and if the Consumer/participant does not participate in the tour without any notification, the Consumer/participant cannot request a refund or reduction of the fees on the grounds that they did not receive the service, He accepts and declares that the fees he has paid are withdrawal compensation.

If TT Touristic cancels the tour/contract before the start of the tour/service for a reason not caused by the Consumer, the Consumer may optionally use one of the rights granted to the Consumer listed in paragraphs a) b) and c) above.

5.7-Even though TT Touristic has shown all necessary care, if the tour/service cannot be started for the reasons stated below or if the continuation of the tour becomes impossible for the reasons stated below and/or if the breach of contract arises from the reasons stated below, TT Touristic cannot be held responsible for the contract not being performed at all or properly;

a) There is fault on the part of the consumer.

b)An unexpected and unpreventable behavior of a third party who is not involved in the execution of the contract.

c) There is force majeure.

d) An event that the package tour organizer, intermediary or independent service provider could not foresee and prevent despite taking all necessary care, occurs,

d) Due to the failure to provide the minimum participation required for the organization of the package tour, the package tour must be canceled and the cancellation must be notified to the Consumer in writing or via a permanent data recorder at least 20 days before the start of the package tour within the period specified in the contract. (If the reason for postponement and/or cancellation of the tour occurs less than 20 days before the start of the tour, TT Touristic cannot be held responsible.)

If the above-mentioned reasons occur before the tour starts, TT Touristic has the right to cancel and/or postpone the tour/service or offer an alternative tour by informing the Consumer in writing or via permanent data storage. If the tour cannot start for the reasons stated above and the Consumer does not agree to postpone the tour or participate in an alternative tour, TT Touristic will cancel the Consumer’s tour. In this case, if the Consumer does not accept TT Touristic’s request for postponement or alternative tour proposal, or if it is actually impossible to postpone the tour, TT Touristic will collect the payments made by the Consumer to TT Touristic for the tour until that date, official payments made for the Consumer (taxes, fees, etc.). except returns to the Consumer. If force majeure occurs after the tour has started, during the performance of the service, TT Touristic’s responsibility is to bring the Consumer back to the starting point of the tour, and TT Touristic cannot be charged with any other liability (refund, compensation, etc.).

5.8-In case of cancellations made by the Consumer without any reason up to 30 days before the start of the tour/service, the price paid will be refunded to the Consumer, excluding the costs arising from compulsory taxes, duties and similar legal obligations. For cancellations made by the consumer between 29 and 15 days before the start of the service, 50% of the reservation fee; In case of cancellations made less than 14 days in advance, the Consumer declares, accepts and undertakes to pay the entire reservation fee to TT Touristic. If the service received is a product within special periods such as New Year’s Eve, semester, holiday period or other campaigns, the above articles of the contract are not valid. In this case, the Consumer has no right to cancellation or refund. Consumer(s)/Participant(s) who have early booking cancellation insurance for domestic tours and early booking cancellation assurance package for cultural tours can use their right to uninterrupted cancellation 72 hours before the start of the service. Otherwise he cannot use it. Consumer’s early booking cancellation insurance or early booking assurance package does not cover flight transportation costs. For cancellations made during international travels, if a visa has been obtained, the visa fee will not be refunded. For tours with air transportation, the Consumer’s cancellation request is evaluated in accordance with the cancellation and change conditions of the carrier airline. The consumer declares and accepts that in case of a cancellation and/or change request for air transportation tours/services, TT Touristic has no involvement in the evaluation of the cancellation and change request, and therefore TT Touristic cannot be held responsible.

In case the Consumer/Participant requests a change in the service, provided that this change is deemed appropriate by TT Touristic, if there is a price difference between the previously received service and the new service requested, the Consumer/Participant must immediately pay the difference to TT Touristic upon acceptance of the change request. However, if the price of the new service is lower than the previous service price, TT Touristic will refund the difference to the consumer.

5.9-Due to a situation or force majeure that the consumer cannot foresee or prevent despite showing all necessary care, he/she will not be able to participate in the tour/receive the service less than 30 days before the start of the tour/service, and cancel the tour/service in writing and/or via TT Touristic with the Permanent Data Storage. In case of notification/request to , any taxes, duties, etc. that must be paid. The price paid by the consumer/participant will be refunded to him/her, except for the expenses arising from legal obligations and the fees that can be paid and documented to third parties/suppliers and which cannot be refunded. If the consumer notifies/requests cancellation of the tour/service as stated above that he/she cannot participate in the tour/receive the service more than 30 days before the start of the tour/service due to the reasons stated above, he/she will be liable for any taxes, duties, etc. that must be paid. The price paid by the consumer/participant will be refunded to him/her, excluding expenses/fees arising from legal obligations.

If the above-mentioned situation occurs during the continuation of the tour, the relevant information and documents must be submitted/submitted to TT Touristic immediately and with the document after the Consumer/participant leaves the tour. If the consumer/participant does not notify in writing as above that he/she will participate in the tour/service that he/she missed the start of; TT Touristic has the right to cancel all reservations and services made on behalf of the Consumer after 24 hours. In such cancellations, no refund will be made to the Consumer. If the Consumer/Participant notifies within 24 hours from the start of the tour/service that he/she will attend the tour that he/she missed the start of and will receive the service, he/she will be responsible for the transportation, etc. that he/she paid/will pay for participating in the tour. If so, he/she will cover any other cost(s).

5.10-TRANSPORTATION BY BUS: Any responsibility regarding the luggage and its contents belongs to the Consumer/Participant. The consumer/participant is obliged to comply with the legislation and practices governing the vehicle in which he will travel and the facility/hotel in which he will stay. In case of loss or damage of the consumer’s luggage in vehicles belonging to TT Touristic due to the intent and gross fault of TT Touristic and its employees, provided that a loss and damage report is prepared, the items in the lost or damaged luggage are included in the reservation fee, regardless of their material and moral value and other qualities and characteristics. Maximum 1/2 of the transportation portion is paid by TT Touristic to the Consumer/participant who owns the goods as material and moral compensation for lost goods and luggage. In bus transportation, seat numbers are determined automatically by the system. For this reason, TT Touristic does not guarantee seat numbers in vehicles. All other details regarding transportation are arranged in the voucher/brochure and given/communicated to the Consumer.

5.11-TRANSPORTATION BY AIRPLANE: Since the regulations regarding charter flights are subject to international aviation rules, airlines have the right to change any time and plan changes, aircraft type and airline company in these flights. Departure time cannot be guaranteed, the carrier airline may change the stopping places shown on the tickets, make transfers or stopovers. The times specified during the sale are possible hours, and TT Touristic cannot be held responsible for any flight time changes made by the airline company. If cancellation of the tour/contract is requested due to flight times having changed, no refund can be made to the Consumer/participant. In case of cancellation of charter, i.e. non-scheduled flight tickets, refunds cannot be made due to the nature of the flight ticket. For matters not written in this contract, the relevant legislation provisions in force, IATA, IHA, UFTAA Convention provisions, Civil Aviation Law, International agreements in which Turkey is included and the Statutes, Regulations, Circulars and Communiqués issued accordingly, rules and instructions of airline companies are applied. The Consumer/Participant declares and accepts that if he/she does not use outbound transportation in airline package tours, he/she will not be able to use return transportation in accordance with the airline rules, and that TT Touristic cannot be held responsible in such a case. TT Touristic acts as an intermediary between the airline and Consumers and is subject to the Hague Protocol dated 28/09/1955 and the provisions of the Montreal Convention. Consumer(s) declare, accept and undertake that they have purchased the tour/service by knowing and accepting the risk of time change. TT Touristic, which has the status of an Intermediary Institution, is obliged to notify the Consumer of such changes as soon as it receives notice. In order to avoid any inconvenience, the Consumer must call TT Touristic at least 48 hours before the flight and confirm the flight time. In case of baggage loss and damage that may occur during air transportation, the rules of the relevant airline company and the provisions of the International Convention on the subject are valid, and the Consumer/participant will demand compensation from the airline company for the damages arising from the loss and/or damage of his/her baggage. The Consumer is required to provide accurate and complete birth dates and other personal information of himself and the Participant/s and/or enter them into the system during the reservation/contract signing/making phase, and is responsible for preventing the date/s of birth and other personal information from being given incorrectly or entered into the system incorrectly. TT Touristic cannot be held responsible. If this situation is noticed at check-in, the sanctions and rules of the relevant airline will apply.

5.12-ACCOMMODATION SERVICES: The Consumer/Participant shall obtain all kinds of information about the facility/hotel from which he/she will receive services/accommodate within the scope of the contract, both from TT Touristic’s website and/or from TT Touristic sales representatives, and sign/make the contract after making all necessary examination and reading, and other He accepts and declares that he has/will inform the participants. If the facility/hotel is not able to provide service on the date the stay begins, or if the facility/hotel cannot provide service due to reasons arising from the facility/hotel and/or force majeure, TT Touristic may offer the consumer to stay in another facility/hotel that has the same standards as the facility/hotel from which the consumer purchased the service. If the consumer does not accept such a change, he has the right to receive a refund of the total price paid for his reservation. It is the number of overnight stays valid for package tours. The first night of accommodation of the package tour is counted as the first day and the first night. TT Touristic is not responsible for Consumers/Participants not being able to benefit from daylight or late check-in to the hotel/facility due to delays in transportation vehicles due to force majeure or delays made by the airline company. In case of any loss of luggage, valuables and similar items in the facility where the Consumer/Participant is staying, in case of tort and/or unfair attack, it is the Consumer’s own responsibility to file the necessary reports with the relevant law enforcement authorities. TT Touristic and its employees cannot be held responsible for these and similar situations. If the Consumer terminates the service received due to defective service and wishes to withdraw from the contract, the Consumer must immediately notify the TT Touristic official and the facility/hotel he/she is staying in, in writing, of the reasons for terminating the service and withdrawing from the contract. If the consumer acts contrary and leaves the facility/hotel without making any notification, the consumer/participant is deemed to have received and used the service. During the reservation stage, the consumer/participant must provide the requested information (date of birth, personal information required for registration, etc.) accurately, in accordance with the official records and completely, both for himself and the other participants with whom he has made a contract, and enter it into the system, and ensure that the information he provides and the registration information are up to date. He must personally check the information and correct any errors. During the registration to be made upon entering the booked facility/hotel, in case the facility/hotel determines that the birth dates and personal information of the Consumer/s-participant/s do not match the contract/voucher information or are incorrect, the Consumer(s-Participant/s) must comply with the rules of the hotel they have made a reservation for. and must fulfill its sanctions (for example, in case of a price difference due to incorrect information provided/entered, paying the resulting price difference to the hotel). TT Touristic cannot be held responsible if such a situation occurs. The Consumer/Participant is required to protect and preserve the belongings he/she keeps with him during the performance of the tour/service, and declares and accepts that TT Touristic is not responsible for the loss, theft and/or loss of his/her belongings during the performance of the tour/service.

.13-VISA PROCEDURES AND SERVICES: Visa procedures and services are not included in the service and service fee purchased under this contract. The subject of these articles is the regulation of the procedures and principles regarding the visa service to be provided to the Consumer/participant by the authorized agency that TT Touristic works externally, in case the Consumer/participant who will participate in an international tour with TT Touristic requests TT Touristic to undertake the visa follow-up process required for going abroad. The documents required for the visa application, visa expenses and visa service fee must be delivered to the authorized agency by the Consumer/participant upon the request of TT Touristic and TT Touristic, in full, as notified by the relevant Consulate, at least 30 days before the tour departure date. The passport delivered must have a validity of at least 6 months from the end date of the trip/tour. If the Consumer/Participant delivers his/her passport and the necessary documents requested for visa to T@ViewData["CompanyName"] or its authorized agency completely and without any errors, the Consumer/Participant agrees to be present at the consulate on the date and appointment time given by the consulate, together with the requested documents in addition to the personal application, if requested by the relevant consulate. and declares. If the Consumer delivers his/her passport and documents to TT Touristic or its authorized agency and the delivered documents are deemed insufficient or incomplete or erroneous by the relevant consulate, the Consumer/Participant must complete the additional documents/documents requested by the relevant consulate within the period determined by the consulate, without error and in full, and must be submitted to the agency or relevant consulate. Otherwise, TT Touristic cannot be held responsible for not delivering the additional documents/documents requested by the relevant consulate in full and/or for not correcting the incorrect documents and/or for not delivering them on time. TT Touristic and the authorized visa agency cannot be held responsible for the consumer/participant not fulfilling his/her responsibilities completely and/or on time, or for not obtaining the visa on time despite fulfilling it/for the relevant consulate rejecting the visa request/for not returning the passports on time. Because TT Touristic and the visa agency are not included in the law between the relevant country consulate and the consumer/participant applying for a visa. For this reason, expenses made on behalf of the consumer are not refunded to the consumer/participant. Although the consumer has submitted all the documents on time and completely and the agency has applied on time, TT Touristic is not responsible for the decision to reject the visa request by the relevant consulate. However, if the passports are not delivered by the relevant Consulate until the start day of the tour due to reasons not caused by the parties, TT Touristic or the agent’s liability will not arise. If the visa cannot be obtained as a result of the Consumer’s actions contrary to the rules of good faith (tax debt, military status, travel ban, blacklist status, etc.), TT Touristic or its authorized agency will not be held responsible for the Consumer not being able to obtain a visa and not being able to go abroad. No refund/refund will be made to Consumers/participants who are not allowed into the destination country for any reason, even though all visa procedures have been completed validly, or who are not allowed to leave Turkey even though their visas are valid, and TT Touristic or its authorized agency will not be responsible for any damages arising from this situation. It is known and accepted by the Consumer in advance that this situation is the decision and disposition of the administrative authorities of the country of destination and the country of which he/she is a citizen. The consumer/participant is obliged to have a valid passport without any damage or deformation, as accepted by the legal and competent authorities, from the beginning to the end of the tour. TT Touristic cannot be held responsible for travel cancellations that may occur at the exit or entry of the country due to damage or deformation in the passport. The consumer/participant who declares that he/she has a visa for the countries of the tour they will attend or who states that he/she will personally follow up the visa procedures cannot terminate the contract or request a refund by claiming that the visa procedures are not completed or that he/she cannot obtain a visa; the responsibility belongs to the consumer/participant. TT Touristic or its authorized agency has no right or authority to impose sanctions on the Consulates or to undertake the acquisitions of the Consulates. Since it is an intermediary institution, TT Touristic and/or its authorized agency have no liability for delays and bureaucratic transactions/procedures at consulates. If the documents returned by the Consulate are returned to TT Touristic or its agency, the returned documents are returned/delivered to the Consumer/participant by TT Touristic or the authorized agency. If the consulate does not grant a visa TT Touristic has no responsibility, and the reason for not being able to obtain a visa is legally based on the Consulate declaration.

5.14-Consumer/Participant can pay the contract price in cash and/or in cash with banks’ credit cards or in installments with banks’ installment credit cards. In payments made by credit card, if the credit card debt is not paid, the consumer’s addressee is the bank with which he signed the credit card contract. TT Touristic is not a party to this dispute. Consumers who purchase services by credit card cannot prevent their banks from paying on the grounds that they do not personally use the purchased service. The consumer/participant who purchases services with a credit card must notify the bank to which the card belongs and make their requests for early payment or installment reduction to the payment branches determined by the bank. 5.15-TT Touristic will be able to provide all information to the consumer in writing, in person or through a permanent data storage device (e-mail, text message, disk, CD/DVD, memory card and any similar tool or medium). If the consumer/participant sees that the service is defective during the execution of the contract, he/she must immediately notify the TT Touristic officials/tour managers in writing about which service(s) is defective and why, and the facility officials if the defect claimed by the tour guide originates from the facility/hotel. It is the duty of a good-faith consumer to cooperate and act diligently by notifying TT Touristic and/or the facility where the consumer is staying in writing about the issues he/she is complaining about during the tour. Otherwise, the Consumer/Participant who does not report any defects during the performance of the service, or leaves the hotel/tour without any notification, is deemed to have left the tour/hotel without a justified reason and is deemed to have received and used the service, and cannot claim a refund of the tour/service fee or compensation for damages.

5.16-If the tour/service cannot be completed after its start for a reason arising from TT Touristic or if the service provided is found to be defective, TT Touristic offers equivalent alternative arrangements (hotel, etc.) that do not bring additional costs to the Consumer/Participant for the Consumer/Participant to continue the tour. If the alternative arrangement/offer offered by TT Touristic is accepted/used by the Consumer/Participant, the Consumer/Participant cannot claim any refund and/or compensation. ARTICLE 6: FINAL/OTHER PROVISIONS

6.1-The consumer gives information to TT Touristic employees and/or websites during the reservation; e-mail, mobile phone, fax etc. He/she accepts and declares that he/she allows the information, newsletter submissions made by TT Touristic and its websites for campaign announcement purposes. If the consumer declares that he does not want notifications and announcements made to his own communication channels, T@ViewData["CompanyName"] undertakes to terminate e-mail, SMS, fax and postal sending.

6.2-All Consumers/participants, including the children who have signed or are mentioned in this contract, are obliged to have their updated identity cards with them while participating in the domestic tours and to present this package tour service and sales contract to the receptionist when entering the hotel; During international tours, he/she must also carry his/her passport with the above-mentioned qualifications and present it to the institutions and competent authorities that request presentation. If it is understood that the characteristics declared during the reservation (such as age, honeymoon couple, etc.) of the children/persons who will stay free or at a discount in line with the criteria determined by the facility are not correct, the Consumer/participant will pay the difference fee immediately and in full and make any compensation. The Consumer/Participant is obliged to comply with the local rules, customs and traditions of the region and country where the tour is organized, and the conditions and rules of the facility/hotel where he/she will stay. The consumer will comply with the warnings and restrictions of the tour guide, TT Touristic, the region where the tour is organized, and the authorities/officials of the local administrations of the country.

6.3-The tour guide, the tour program, meteorological reasons, events on the route where the tour will be organized, traffic density, restrictive decisions taken by the general and local administrations of the country where the tour is organized, etc. For reasons such as but not limited to those listed above, the order of the places to be visited, visit plans and times may be changed, provided that the tour is completed completely. 6.4-Pets are not accepted in transportation vehicles and in the accommodation facility. 6.5-Tours or services specified in the preliminary information and brochure are subject to extra fees. For all package tours, extra tour fees and contents are determined and recommended by local agencies in the cities and countries visited. Extra tours can only be made if sufficient participation is ensured, and no compensation and/or refund can be requested from TT Touristic due to insufficient participation or not taking the tour for reasons not caused by the tour organizer. Since TT Touristic has no involvement in extra tours, TT Touristic cannot be held responsible for any disruptions that may occur in the extra tour(s), route changes, defective service, or failure to conduct the tour due to reasons similar to the reasons listed, including but not limited to the ones mentioned. The Local Agency may change the extra tour fee due to insufficient participation. It is up to the Consumer’s choice whether to participate in the extra tour or not at the price changed by the Local Agency and notified to the Consumer. 6.6-Consumer; will comply with the rules declared by the guide, facility/hotel, transportation vehicle driver, local agency, authorized agency in case of visa service, insurance company and TT Touristic; He declares and accepts that he will respect the life, property and peace of third parties, otherwise, he will be removed from the tour/facility, he will not be able to receive/use the service, and he will not have the right to a refund and/or any compensation since he will not be able to receive the service due to reasons arising from himself. TT Touristic is not responsible for situations arising from the personal responsibilities of the consumer/participant and third parties.

6.7-Children under the age of eighteen (18) must obtain a notarized consent from their father if they are traveling with their mother, from their mother if they are traveling with their father, and from both their mother and father if they are traveling with a third person. Flights to Cyprus, including children, can be made with an official photo ID. (Driver’s license, marriage certificate, etc. are not valid.)

6.8-Room blocking is done by the facility/hotel where the Consumer will stay and TT Touristic cannot directly intervene. Therefore, TT Touristic cannot be held responsible for the room allocated to the Consumer.

6.9-In addition, if the Consumer wishes, he/she may, at his/her own expense, obtain additional insurance for the costs of returning to the starting point in case of an accident or illness before the start of the package tour service, as well as the costs of damage and treatment arising from any accident. In this regard, the consumer was also informed and enlightened when signing the contract. Travel insurance assurance package fees belong to the consumer/participant who wishes to benefit from it. In accordance with Article 12 of the Consumer Law No. 1618, cases where the service is not performed at all or is performed incompletely are covered by insurance in line with the scope of the policy, and the coverage is equal to the tour price.

6.10- Consumers/participants who do not have a signature on the contract, but whose names are mentioned in the contract (on whose behalf a reservation is made) and who participate in the tour, declare that they “authorize the Consumer who has signed the contract to make a contract on their behalf, and that all terms of the contract are accepted by them as soon as the Consumer who made/signed the contract makes/signs this contract.” They are deemed to have accepted that they will be deemed to have been accepted and that they will comply with the terms of the contract exactly. 6.12-Even if the consumer cannot sign this contract for any reason by making the payment for the tour subject to the contract by mail order, virtual POS, money transfer or EFT, he/she will be informed that the contract has been sent to him/her by TT Touristic with a permanent data storage, he/she has examined the contract and the terms of the contract and wants to purchase it. 6.16-The Parties agree that TT Touristic’s books and documents and records kept electronically, minutes and telephone records to be kept by TT Touristic employees or other service providers about the Consumer are exclusive evidence.

6.17-The consumer declares that he/she accepts that in case of default in payment obligations arising from this contract or legislation, legal interest will be applied at the rate specified in Article 1 of Law No. 3095.

6.18-The parties may apply to the TÜRSAB ARBITRATION BOARD for the resolution of all disputes arising from this agreement, as well as the Consumer Arbitration Committees, Consumer Courts and other authorized and authorized institutions and authorities in their settlements.

6.19-If one or more articles of the contract are deemed invalid for any reason, the other provisions of the contract will not be affected by this invalidity and will remain in force. ARTICLE 4: CONTRACT PRICE AND PAYMENT

4.2.The consumer can pay for the services he/she received and/or will receive under this contract in cash (via money order/EFT) or by credit card. In payments to be made by credit card, the Consumer declares and accepts that TT Touristic is authorized to collect the contract fee from the credit card whose information he has provided, that he will not object to any withdrawal or collection made by TT Touristic regarding the accommodation fee, and that he will not object to the slip or request a chargeback.

4.3.In accordance with the relevant provisions of the Tax Procedure Law; The invoice to be issued for the service purchase is issued by TT Touristic following the completion of the service and sent to the address (e-mail or notification) specified by the Consumer in the contract.

4.4.At least 25% of the accommodation fee at the time of reservation, and the balance must be deposited no later than 7 days before the start of the service for reservations made for summer/beach hotels and city hotels; 25 days until the service starts for reservations made for winter/ski resort hotels; For reservations made for thermal hotels, payment must be made 15 days before the start of the service. If there is less than 7, 25 and 15 days between the reservation and the start date of the service, respectively, the full accommodation fee must be paid. Depending on the booked hotels, if the specified payments are not made 7, 25 and 15 days before, respectively, the reservation will be canceled and if there is more than 7, 25 and 15 days respectively until the start of the service on the date of cancellation, 25% of the reservation fee will be paid as withdrawal compensation, 7.25 and if less than 15 days remain, the entire amount will be collected from the Consumer.

The Consumer who purchases a Discounted Product/Special Product or a campaign product is obliged to pay the full service fee on the reservation date. If the service received is a product within the scope of early reservation or other campaigns, and if the balance payment is not made on time, the Consumer pays a withdrawal compensation equal to the entire accommodation fee.

4.5. In case of a price increase in the price of the accommodation/product/service subject to the contract after the contract is signed/made, but before the service is used, the Consumer will not be charged a difference fee due to the price increase, and the price/price of the accommodation/product/service decreases (for example, In case of action taken by the hotel (such as reducing the price), no refund will be made to the Consumer. The consumer cannot request the cancellation of the contract by claiming that the price has decreased, nor can he request the refund of the price difference. The information regarding the details/necessary information is understandable and a copy of the preliminary information brochure given to him by TT Touristic before the contract is established is also included in the annex of this contract, Permanent Data Storage (e-mail, text message, disk, CD/DVD, memory card and any similar vehicle or environment) and the provisions of this contract have been explained to him separately, that he has concluded this contract on behalf of the Participant/s who will accommodate him in accordance with the contract, that he has/will inform the Participant/s about all the information given to him and the contract details, that this obligation declares and accepts that it belongs to him/her, that the information given to him/her will be deemed to have been provided to the other participant/s, that the material, moral and legal responsibility for informing the other participants about the terms and conditions of the Agreement belongs entirely to him/her, and that the contract has been drawn up and signed/approved in line with his expressed will to accept the contract. 5.2.Consumer; TT Touristic undertakes that the Hotel officials and the Agency representative will comply with the rules stated by the insurance company regarding the purchased service, respect the life, property safety and peace of third parties, prevent the stay of other Consumers staying in the hotel, disturb the peace within the hotel, etc. He declares and accepts that he will refrain from such behavior, otherwise, even if he has started to receive service, he may be expelled from the hotel, he will not be able to receive the service, and he will not have the right to a refund and/or any compensation since he will not be able to receive the service due to reasons arising from himself. TT Touristic is not responsible for situations arising from the personal responsibilities of the consumer/participant and third parties.

5.3.As a rule, the consumer is obliged to pay the full accommodation/service fee at the time of reservation. However, if the Consumer cannot pay the full accommodation/service fee at the time of reservation due to reasons arising from the Consumer, he/she must pay at least 35% of the accommodation/service (reservation) fee at the time of reservation and the remaining balance (65%) within 15 days from the date of reservation. ) is obliged to pay. The consumer declares, accepts and undertakes that he/she is aware that the reservation will not be finalized without making the full payment and that TT Touristic has been informed about this. If there is less than 15 days between the reservation date and the accommodation (service start date), the Consumer declares, accepts and undertakes that he/she is obliged to pay the entire accommodation/service (reservation) fee at the time of reservation, otherwise the reservation will not be finalized and TT Touristic will not be responsible for this. . If payment(s) are not made within the period(s) specified above, the contract is deemed to be terminated unilaterally by the Consumer without justifiable reason. 5.4. In case of any loss of luggage, valuables or similar items at the Hotel where the Consumer is staying, the Consumer will inform the Hotel official and have the necessary reports filed with the relevant law enforcement authorities. If the Consumer informs TT Touristic about the incident, TT Touristic will also inform the Hotel. Since TT Touristic was not involved in this situation, it has no responsibility. If the hotel is at fault, the Consumer may exercise his legal rights against the hotel.

5.5.The Participant (who does not have a signature on the contract, but whose name is mentioned in the contract, on whose behalf the reservation is made) authorizes the consumer who has signed the contract to make a contract on his/her behalf, and that the Consumer who signed the contract will be deemed to have accepted all the terms of the contract upon signing this contract, and He/she is deemed to have accepted that he/she will comply with the terms of the contract exactly. For this reason, he cannot claim that the contract is not binding on him on the grounds that he does not have a signature on the contract. However, despite all this, if the Participant claims that he is not bound by the contract on the grounds that he does not have a signature on the contract, the Consumer who has signed the contract will be responsible for all losses of TT Touristic. The Consumer who signs the contract declares and accepts that the names of himself and the Participant on whose behalf he made the contract are correct and that he is responsible for the information he provides incorrectly.

5.6.Room blocking is done by the hotel where the Consumer will stay and the agency cannot directly intervene. Therefore, TT Touristic cannot be held responsible for the room allocated to the Consumer.

5.7. Even though T@ViewData["CompanyName"] has shown all necessary care, if the accommodation/service cannot be started for the reasons stated below, or if the continuation of the accommodation/service becomes impossible for the reasons stated below and/or if the breach of contract arises from the reasons stated below, TT Touristic is responsible for the contract not being performed at all or properly. cannot be kept;

a) The consumer cannot use, consume or perform the service and accommodation he has purchased due to his own fault or actual impossibility caused by him,

5.8.Consumer/Participant can pay the contract price in cash and/or in cash with banks’ credit cards or in installments with banks’ credit cards that make installments. The consumer can make payments in cash or in installments for himself, his companions or third parties who will participate in the trip, by credit card. If the service purchased by the consumer in advance or in installments by credit card is canceled for any reason, or if there is a need to make a refund under the terms of the contract or to partially or fully refund the price due to the cancellation of the service, TT Touristic will transfer the refund to the consumer/participant’s credit card (the credit card from which the payment was made). card) will do. The consumer/participant cannot request that the refund be made to his/her account and in cash. The refund is returned to the card of the consumer/participant by the bank, in accordance with the business rules of the banks and the provisions of the contract made between the bank and the consumer. Bank rules also apply to refunds for payments made in installments, and if payments made in installments are returned to the card in installments, TT Touristic has no liability and does not have the right or opportunity to intervene. If the payment is made by credit card by a third party on behalf of the Consumer/Participant, the refund will be returned to the credit card from which the payment was made, following the same procedure. 5.9. If the consumer sees that the service is defective during the execution of the contract, he/she must immediately inform TT Touristic officials in writing about which service(s) is defective and why, and the reasons, or to the facility/hotel authorities if the alleged defect originates from the facility/hotel. It is the duty of a good faith consumer to cooperate and act diligently to inform TT Touristic and/or the hotel where he/she is staying in writing about the issues the consumer is complaining about. Otherwise, the Consumer/Participant who does not report any defects during the performance of the service or leaves the hotel/facility without making any notification is deemed to have left the hotel/facility without justifiable reason and is deemed to have received and used the service, and cannot claim a refund of the accommodation/service fee or compensation for damages.

5.10.TT Touristic, in the event of a situation beyond its control (force majeure), may partially or completely change or cancel the Consumer’s reservation, up to 7 days before the start date of the service, and 1 day before the special days and/or periods, provided that it notifies the Consumer. If the consumer does not accept these changes and cancellation, he has the right to cancel his reservation and receive a full refund of the fee he paid.

If the accommodation/service cannot be completed after its start due to a reason arising from TT Touristic or if the service provided is determined by TT Touristic to be defective, TT Touristic offers equivalent alternative arrangements (hotel, facility, etc.) for the accommodation of the Consumer/Participant that do not impose additional costs on the Consumer/Participant. If the alternative arrangement/offer offered by TT Touristic is accepted/used by the Consumer/Participant, the Consumer/Participant cannot claim any refund and/or compensation.

If the Consumer/Participant wishes to withdraw from the contract by not accepting the alternative arrangement offered by TT Touristic, he/she must notify TT Touristic of his/her intention to withdraw from the contract in writing or via a permanent data recorder. The Consumer who leaves the hotel/facility without any notification with contrary behavior is deemed to have received and used the service. 5.13.TT Touristic, in accordance with the legal legislation, especially the Personal Data Protection Law No. 6698, personal data of the Consumer/Participant; In accordance with Article 5 (2) (a) and (d) of the Law, it is clearly foreseen in the law and is necessary for the fulfillment of the legal obligation, and in accordance with Article 5 (2) (c), to fulfill the rights and obligations arising from the contract by establishing the contract, Law article It may be processed based on its legal reason and purpose, if it is necessary for the protection and establishment of the right in accordance with Article 5 (2) (e), and if it is required by legitimate interests, provided that it does not harm fundamental rights and freedoms in accordance with Article 5 (2) (f) of the Law.

ARTICLE 6: RIGHT OF WITHDRAWAL, DURATION AND TERMINATION

6.1. If it is not possible for the consumer to continue the purchased accommodation/service, the consumer may cancel his/her reservation up to 14 days after the reservation date or, provided that it complies with the same reservation type, the product/service/contract other than early reservation and discounted products can be purchased by the desired person or person. can be transferred to individuals. The transferee is jointly and severally responsible with the transferor for the balance and all expenses arising from the transfer. 6.2. When the consumer requests cancellation up to 30 days before the start of the service, the price paid will be refunded to him/her, excluding the costs arising from compulsory taxes, duties and similar legal obligations. If the consumer wishes to cancel the contract 30-15 days before the start of the service, 50% of the price paid; If he/she wishes to cancel less than 15 days in advance, he/she accepts and undertakes to pay the entire amount to TT Touristic. Date changes made by the consumer have the effect of cancellation.

6.3.In case of cancellation/transfer of the discounted service; In case of cancellation/transfer made up to 7 days before the start of the service, the Consumer agrees and undertakes to pay 50% of the service fee to TT Touristice, and after 7 days, the entire service fee. 6.4.If the consumer does not notify in writing that he will participate in the service whose start he missed; TT Touristic has the right to cancel all reservations and services made on behalf of the consumer after 24 hours from the start date of the service. In such cancellations, no refund will be made to the Consumer.

6.5.Provided that the consumer certifies his or his first-degree relatives’ illnesses that prevent his or her normal activities for 10 days corresponding to the accommodation period, with an official report from a full-fledged state hospital or in case of death, the reservation cancellation request will be accepted and the amount paid for the reservation will be refunded to him/her. In this case, the report and documents will be submitted before the start of the service. If this situation occurs during the continuation of the accommodation service, the excuse must be submitted to TT Touristic together with the document within 3 days from the date of departure from the Hotel. In this case, the amount of the days for which accommodation service was not received will be refunded.

ARTICLE 7: OTHER PROVISIONS

7.1. If the consumer wishes, before the start of the accommodation service, in case of an accident or illness that may occur during the accommodation, the consumer can insure the expenses of returning to the place of residence and the damages and treatment expenses arising from any accident, at his own expense. Travel insurance: The scope of coverage for damages, losses and losses of Consumers who purchase the service is determined by the policy of the insurance company offering this service. TT Touristic does not bear any responsibility for the content, scope or application of these guarantees. It is entirely at the discretion of the Consumer whether or not to obtain this insurance.

7.2.Even if the consumer cannot sign this contract for any reason by making the payment for the reservation subject to this contract by mail order, virtual POS, money order or EFT, the terms of this contract will be valid between the parties. In this case, the consumer must submit the terms of the contract and the service he/she wants to purchase and information about the service, sales price, payment methods, validity dates of the prices, etc. He declares and accepts that he has learned all the necessary information from TT Touristic’s catalogue, website and advertisements, that he has read and reviewed the contract on TT Touristic’s website, that he cannot proceed to the payment phase without reading the contract, and that he has received the services specified in the contract within the written conditions in this contract.

7.3.The consumer can obtain the contract regarding this reservation, all kinds of information about the hotel mentioned in the contract, contract terms, sales price of the service, payment terms and method, both from TT Touristic’s web addresses, from TT Touristic’s catalog, advertisements and from TT Touristic sales representatives. , accepts and declares that, after making all the necessary examination, obtaining and reading detailed information, he agrees with the terms of the contract and signs it.

7.4.TT Touristic has announced the qualifications of the booked hotel, its star rating and information about the services offered, based on the hotel’s declaration, brochures and information on the hotel’s official website. If the hotel does not have the features and star rating standards stated in its announcements and declarations, the responsibility belongs exclusively to the hotel. If the hotel does not meet the promised standards or is not able to provide service at this standard on the date the stay begins, TT Touristic may offer the Consumer to stay in a facility of the same standard or in a higher category. If the consumer does not accept such a change, he can cancel his reservation and request a refund of the price he paid.

7.5.TT Touristic receives the identity and age information from the Consumer according to the Consumer’s declaration during the reservation, but the identity and age check is carried out by the hotel upon entering the hotel. For this reason, if a difference arises due to a false or incomplete declaration made by the Consumer, this difference will be collected from the Consumer by the hotel at the time of check-in.

7.6.The consumer gives information to TT Touristic employees and/or websites during the reservation; e-mail, mobile phone, fax etc. He/she accepts and declares that he/she allows the information, newsletter submissions made by TT Touristic and its websites for campaign announcement purposes. If the consumer declares that he does not want notifications and announcements made to his own communication channels, TT Touristic undertakes to terminate e-mail, SMS, fax and postal sending.

7.7. All Consumers/participants, including the children who have signed or are mentioned in this contract, must have their updated identity cards with them when entering the facility/hotel and must present this accommodation service and sales contract to the receptionist when entering the facility/hotel. If it is understood that the characteristics declared during the reservation (such as age, honeymoon couple, etc.) of the children who will stay free or at a discount in line with the criteria determined by the facility are not correct, the Consumer/participant will immediately and fully pay the difference and make any compensation. 7.8. Pets are not accepted in the accommodation facility/hotel.

7.10.The Parties declare that the address, telephone and e-mail addresses/information specified in this agreement are correct, and in case of any change in the address, telephone and/or e-mail address (contact information), the change must be sent to the other party in writing within 7 days at the latest. They declare, accept and undertake that they will notify them in accordance with the procedures specified in the regulation, otherwise, the other party will not be responsible for any disruptions, delays and damages that may arise from not being informed at all or on time in accordance with this agreement.

7.11.The parties agree that the provisions of TÜRSAB KÜTAHYA SCHEDULE will be applied primarily in calculating the compensation to be paid in case TT Touristic does not fully or partially comply with the contract.

7.12.The Parties agree that TT Touristic’s books and documents and records kept electronically, minutes and telephone records to be kept by TT Touristic employees or other service providers about the Consumer are exclusive evidence.

7.13.The consumer declares that he/she accepts that in case of default in payment obligations arising from this contract or legislation, legal interest will be applied at the rate specified in Article 1 of Law No. 3095.

7.14.The Parties may apply to the TÜRSAB ARBITRATION BOARD regarding the resolution of all disputes arising from this agreement, as well as the Consumer Arbitration Committees, Consumer Courts and other authorized and authorized institutions and authorities in their settlements.

7.15. If one or more articles of the contract are deemed invalid for any reason, the other provisions of the contract will not be affected by this invalidity and will remain in force. This contract has been drawn up in accordance with the Consumer Protection Law No. 6502 and the relevant regulations, and the provisions of the Law No. 6502 and the relevant regulations shall apply to matters not regulated in the contract and, if any, to matters conflicting with the Law.

7.16.After the contract is made, the emergence of a situation that was not foreseen by the Parties, war, natural disaster, earthquake, flood, fire, declaration of a country-wide or partial state of emergency, death of the Consumer/Participant, strike throughout the country, terrorist incidents, unforeseen technical conditions, It becomes impossible to reach and/or stay at the hotel where accommodation services will be provided due to adverse weather conditions, travel ban throughout the country and/or the region where the hotel is located, quarantine, etc. events are force majeure.
